Lostgamer is a home for exploring the worlds of your favourite games. These terms set out what you can expect from us and what we expect from you. Please read them; if you have any questions, ask us.
1.About these terms
These terms are an agreement between you and Edenstorm Ltd, a company registered in England and Wales (company number 13442311, registered office 128 City Road, London, EC1V 2NX, United Kingdom), which runs Lostgamer (“we”, “us”). They cover lostgamer.io and everything on it: Guessr, the interactive maps, the map creator and the rest.
By using Lostgamer you agree to these terms, and to our Privacy Policy and Cookie Policy, which explain how we handle your data. If you don't agree, please don't use Lostgamer.
2.Who can use Lostgamer
You must be at least 13 to use Lostgamer. If you're under 18, or under the age of digital consent where you live, you need a parent or guardian's permission, and they agree to these terms for you.
3.Your account
You can play without an account, as a guest player tied to your browser. Making an account keeps your games, profile and leaderboard places across devices. When you make one:
- Give us a real email address you can use, and keep your password to yourself. You're responsible for what's done with your account.
- Use one account. Don't share it, sell it, or use someone else's.
- Choose a username that doesn't impersonate anyone, isn't offensive, and doesn't suggest you speak for Lostgamer or anyone else. We may change a username that breaks this.
- Tell us at once if you think someone else has got into your account.
4.Fair play
Leaderboards and duels only mean something if everyone plays fairly. You agree not to:
- Use bots, scripts, browser extensions or other tools to play, guess or find locations for you.
- Look up answers in outside tools while playing ranked games, daily challenges or duels, or have someone else play for you.
- Use more than one account to climb leaderboards or to play yourself in duels.
- Exploit bugs instead of reporting them to us.
- Copy, scrape or download panoramas, locations, map data or other content in bulk, or get around how they're served.
- Interfere with Lostgamer or other players: overloading our servers, probing for weaknesses, or getting around rate limits, blocks or bans.
We check replays and play patterns for cheating. If we find it, we may remove scores, reset or take away titles and leaderboard places, or suspend or close the accounts involved.
You're welcome to stream Lostgamer and post videos of your games, including where you earn money from them, as long as you don't present them as made or endorsed by us.
5.What you make and send us
Maps you create, their names and descriptions, your profile, location reports and suggestions are your content. You keep ownership of it. So that we can run Lostgamer, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and adapt it (for example, making a map's art from its locations) as part of Lostgamer and in showing what Lostgamer offers. The licence ends when you delete the content or your account, except where it's part of games others have already played, or we've already used it.
Suggestions and feedback are gifts: we may use them freely, without owing you anything, though we'll always be glad of them.
Your content must not:
- Break the law, or anyone else's rights, such as their copyright or privacy.
- Be hateful, harassing, sexually explicit or violent, or target other players.
- Contain spam, advertising or links meant to mislead.
We may remove content, or make a map private, that breaks these terms or that we're asked to remove for a good legal reason. If you think something on Lostgamer breaks the law or your rights, email us at [email protected].
6.Our content, and the games
Lostgamer itself (the site, its code and design, its panoramas, maps, locations and the data on the interactive maps) belongs to us or the people who license it to us. You may use it to play and to enjoy Lostgamer, but not copy, sell or build another service from it.
The games Lostgamer is about, their names, logos, artwork and worlds belong to their publishers and developers. Lostgamer isn't affiliated with, sponsored or endorsed by them, and refers to their games only to describe what you're playing.
8.Changes to Lostgamer
We're always working on Lostgamer, so features, games, maps and modes will change, and some may be retired. We'll try to give notice of big changes, but can't promise Lostgamer will always be available or free of errors, or that a particular game or feature will stay. We may need to pause it for maintenance or to deal with problems.
9.Suspending or closing accounts
You can stop using Lostgamer and delete your account at any time from Settings. We may suspend or close your account, or limit what you can do, if you seriously or repeatedly break these terms, if the law requires it, or to protect other players or Lostgamer. Where it's reasonable, we'll tell you why and give you a chance to respond.
If we close your account without you having broken these terms, we'll refund the unused part of any subscription. If we close it because you did, we won't.
10.Our responsibility to you
We provide Lostgamer with reasonable care and skill. If you're a consumer, you have legal rights that these terms don't take away; Citizens Advice can tell you more about them.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit. Otherwise:
- We're responsible for loss or damage you suffer that's a foreseeable result of us breaking these terms or failing to use reasonable care and skill, but not for loss or damage that isn't foreseeable.
- Lostgamer is for personal, non-commercial enjoyment, so we're not responsible for business losses, such as lost profit or business interruption.
- Our total liability to you is limited to the greater of £50 and what you've paid us in the 12 months before the claim.
Lostgamer links to other services (Twitch, Kick, YouTube, Discord, Stripe and others). We aren't responsible for them, and their own terms apply when you use them.
11.Changes to these terms
We may update these terms as Lostgamer changes or the law does, and will change the date at the top when we do. If a change is significant, we'll tell you on the site or by email before it takes effect. If you don't agree with the new terms, you can stop using Lostgamer and delete your account; continuing to use it means you accept them.
12.Law and disputes
These terms are governed by the law of England and Wales, and disputes go to its courts. If you live in Scotland or Northern Ireland, you can also bring proceedings there; if you live in the EU, you keep the protection of your own country's mandatory consumer laws and can bring proceedings there.
If you have a problem, please email us first at [email protected]: most things can be sorted out quickly. If part of these terms is found to be unenforceable, the rest still applies, and if we don't enforce something straight away, we can still do so later.
